IR35 has been around since 1999 – it’s not being rolled out!!!! The problem has been that we have been told to setup Ltd companies as PSC’s, thus avoiding PAYE/NICs on our day rates as a response years ago to this change. Just working with small companies doesn’t really help, as we still need to abide by IR35. Most jobs on-site probably are inside IR35, unless we are running our ltd companies as true(HMRC defined) businesses. most are not! So much confusion on the terms and what we should do….nightmare

That means any company requiring skilled resources they have not got will not have a flexible work-force to call upon in the UK. Surely this will put UK PLC at a disadvantage and business will be lost abroad. I’m not sure if continuing as a freelancer will be worth the effort in the future. It’s a very sad situation.

Sometimes I work for a Company just one or two days. How can I possibly be considered an employee? It’s lots of unnecessary paperwork for me and them plus it’s ridiculous to having to sign a contract for just two days of work. You collect piles and piles of paper. Plus, I used to work a lot via Recruitment Companies but all that work is gone since 2016 because they were not allowed to pay freelancers anymore as sole traders and couldn’t afford to enrol freelancers as payee. I refused to open a limited company or go through an Umbrella Company and the result is that I’m almost not working anymore. Since 2016 life as a freelance has been really hard. I’m worried now it will be even more so.

This is how a decent £500/day specialist contract in London for someone living 100 miles away, would end up giving you little more than a McDonalds job in your own town, therefore killing the concept of workforce flexibility (a train ticket from my town to Paddington is £135, you do the maths if you need to pay that AFTER paying taxes)

Also the legislation makes no mention of freelancers who are ‘sole traders’, ie those who are not registered as limited companies of which there are many. These are the freelancers who work mainly from home and rarely are in-house.

The new system will put (legal) responsibility on the client/employer to pay Tax and NI payments. Therefore, clients/employers will anticipate if they need to or not and preempt rate cuts to balance this?
